1. Deliveries

Unless specified otherwise in the Order Confirmation, transport costs are not included in the sale prices.

2. Delivery Terms

  • The customer will take charge of the merchandise upon delivery at the agreed destination point.
  • For the purpose of calculating the delivery time, the date which appears in the order confirmation shall be the date considered.
  • The delivery date is indicative. The customer will accept a tolerance of 25 days without the right to cancel the order or demand compensation for damages. In cases of force majeure, this tolerance may be extended.
  • For shipments to foreign territories, the delivery date shall be subject to obtaining export and/or import permits or any other administrative procedures.

3. Tolerance in Delivered Quantities

The delivered quantities may vary, either in excess or in defect, from those specified in this order confirmation, by up to ±5% for all products, being the customer obliged to accept the resulting quantity and pay for it according to the agreed price.

4. Tolerance in the Quality of the Finished Products

  • In different productions the colour tones are susceptible to suffer slight differences accepted in the textile industry sector.
  • Tolerance in weight and roll width according to technical data sheet.
  • Tolerance in mechanical properties according to technical data sheet.
  • Products sold by pieces: size tolerance of ± 3%.

5. Storage

The merchandise must be stored in a dry environment, at a temperature below 50ºC, and protected from UV radiation. Storage under inadequate conditions may initiate degradation processes.

6. Solvency

The startup of the order is subject to the favourable classification of the customer by our credit insurance company.

7. Payments

The payment for the merchandise shall be settled as agreed. Late payments shall entitle the seller to charge a delay fee of 2% per month. In case of the return of any payment order document used to document the payment of the merchandise, the customer will bear the expenses incurred as a result, for all concepts. In case of orders agreed with partial deliveries, any non-payment shall entitle the selling company to suspend subsequent shipments until the due payment has been formalized

8. Claims

If, upon receiving the goods, you notice that the packaging is damaged or the number of packages does not correspond to those listed in the shipment, please note this on the carrier’s delivery note. If you do not do so, we will not be able to accept any claims in this regard.

If, upon receipt of the goods, you notice that they do not correspond to what you ordered or you find any problem or defect, please contact our Quality and Environment Department by telephone on 953 59 72 11, or by email at calidad@dntnonwovenfabrics.com. In order to process the claim, we must physically receive the material in question, properly packed and correctly identified with the material labels.

No claims will be accepted more than 90 days after the date of receipt of the goods.

Any cancellations or changes to any details of an order placed must be communicated to the company in a reliable manner (in writing, by fax or email) within 7 days immediately following confirmation of the order; otherwise, the cancellation will result in a penalty for the customer equivalent to at least 50% of the value of the goods (depending on the stage of manufacture).

9. Cancellations and / or modifications of the order

Any cancellations or changes to any detail of a processed order must be clearly informed to the company in a reliable manner (by email) within the 2 business days following the confirmation of the order; otherwise the annulation will result in a penalty for the customer equivalent to, at least (depending on the status of the production process at said time) 505% of the value of the goods.

10. Competent Judicial Authority

In case of litigation, the buyer, expressly waiving his own jurisdiction, submits to the jurisdiction of the Courts and Tribunals of Alcalá la Real (Jaén).

11. Order Confirmation

The entire order will be considered accepted once signed by the customer or upon receipt of partial prepayment.

12. Data protection

In compliance with EU Regulation 2016/679 on personal data protection, the customer is informed that the information contained in this order confirmation form is confidential and intended solely for the persons to whom it is addressed. We inform you that your data will be included in our database and that you have the rights of access, rectification, cancellation, and specification of the same, rights that you can exercise by writing to DNT NON WOVEN FABRICS, S.A.

13. Intellectual and Industrial Property

The intellectual or industrial property rights which may protect the images, logos, designs, or texts that the customer provides to the company for reproduction, are owned by the customer, as stated. Or, otherwise stated, the customer declares to have the license allowing their reproduction. In any case, the customer expressly assumes responsibility towards third parties and the company itself for the reproduction of those images, logos, designs, or texts whose materialization is entrusted to the company. Once the final product is completed, the customer authorizes the company to include it in its sample book and/or catalogue (in physical, digital, web, or any other format), with the only purpose of showing it to third parties as an example of its manufactured products.
